USING CRAB

Terms of Service.

These Terms explain the rules for using Crab, creating and publishing a business page, and the responsibilities that come with using the platform.

Welcome to Crab.

These Terms of Service (“Terms”) govern your access to and use of Crab, including crab.ng, your Crab account, business pages and other services we provide.

Crab provides a platform that helps businesses create a simple digital business identity, display their products or services, and share one public link with customers.

By creating an account or using Crab, you agree to these Terms. If you do not agree with them, you should not create or continue using a Crab account.

1. About Crab

Crab provides tools that allow business owners and authorised representatives to create and manage digital business pages.

A Crab business page may include information such as a business name, description, category, location, availability, products or services, prices, images and contact information.

Crab provides the platform for displaying this information. Unless expressly stated otherwise, Crab is not the seller, supplier, manufacturer or provider of the products and services displayed by businesses using the platform.

Transactions, payments, deliveries, warranties, refunds and other arrangements between a business and its customers are generally matters between those parties.

2. Who may use Crab

You must be legally capable of entering into the agreement created by these Terms or be appropriately authorised to act for the business whose page you create.

Crab is not designed for children to independently create and operate business accounts.

If you create a page on behalf of a business, organisation or another person, you confirm that you have authority to do so and to provide the information you submit.

We may introduce additional eligibility or verification requirements where reasonably necessary for security, legal compliance or particular Crab features.

3. Your Crab account

You are responsible for providing accurate information when creating your account and for keeping relevant account information reasonably up to date.

You are responsible for protecting your login credentials and for activity carried out through your account where that activity results from your authorised use or failure to reasonably protect those credentials.

You should notify Crab if you believe someone has gained unauthorised access to your account.

You may not intentionally access another person's Crab account without their permission.

4. Creating a business page

You may use Crab to create a digital page for a business you own, operate or are authorised to represent.

You are responsible for information placed on your business page.

You should make reasonable efforts to ensure that information such as your business name, products or services, prices, location, availability and contact details is accurate and not deliberately misleading.

Creating a Crab page does not mean that Crab has verified, certified, endorsed or guaranteed the business unless Crab expressly states otherwise.

5. Publishing your business

Business information may remain within your account while you prepare your page.

When you choose to publish a business, information intended for that page becomes publicly accessible through its Crab URL.

This may include your business name, description, location, contact or WhatsApp number, products, services, prices and images.

Important: you are responsible for deciding what information you are comfortable publishing publicly.

Crab may provide controls that allow you to unpublish, republish or delete a business page.

6. Your products, services and customers

Business owners are responsible for the products and services they advertise or provide. This includes responsibility for:

  • Product or service descriptions and prices.
  • Quality, safety and legality.
  • Stock or availability.
  • Delivery and fulfilment.
  • Warranties or guarantees offered by the business.
  • Customer communications.
  • Refunds or returns where applicable.
  • Taxes, licences, permits or regulatory requirements applicable to the business.

Crab does not become a party to a transaction merely because a customer discovered a business through Crab.

If Crab later introduces payment processing, ordering or marketplace functionality, additional terms may apply to those services.

7. Acceptable use

You must not use Crab to engage in unlawful activity or to publish content that you do not have the right to publish.

You must not use Crab to impersonate another person or business, deliberately mislead customers about your identity, distribute malware or harmful code, interfere with the operation or security of Crab, attempt unauthorised access to accounts or systems, or use Crab to facilitate fraud or other illegal conduct.

You must also not upload content that unlawfully infringes another person's intellectual-property, privacy or other legal rights.

Crab may establish more detailed acceptable-use rules as the platform develops.

8. Prohibited or restricted businesses and content

Crab may prohibit or restrict businesses, products, services or content where allowing them would be unlawful, expose users or Crab to unreasonable risk, violate third-party rights, or conflict with platform safety requirements.

This may include unlawful goods or services, fraudulent schemes, stolen goods, unlawful drugs or controlled substances, exploitative or abusive content, malware, and other activities prohibited by applicable law.

Some otherwise lawful products or services may also be subject to age restrictions, licensing requirements or additional platform rules.

Crab may remove or restrict such content where reasonably necessary.

9. Images and other content you upload

You retain ownership of content that belongs to you.

By uploading content to Crab, you give Crab a non-exclusive licence to host, store, reproduce, resize, process and display that content to the extent reasonably necessary to operate and provide Crab.

For example, if you upload a product photograph and publish your business, Crab needs permission to store and display that photograph on your public business page.

This licence does not transfer ownership of your content to Crab.

You are responsible for ensuring that you have the necessary rights or permission to upload and publish the content you provide.

10. Crab's intellectual property

Crab's name, branding, logo, platform design, software and other materials created by or for Crab may be protected by intellectual-property laws.

Except where permitted by law or expressly authorised by Crab, these materials may not be copied, sold, impersonated or used in a manner that falsely suggests affiliation with or endorsement by Crab.

Nothing in these Terms transfers ownership of Crab's technology or branding to users.

11. Business links and sharing

Crab may provide a public link such as crab.ng/your-business-name.

You may share your public Crab business link through WhatsApp, social media, messages, printed materials or other channels.

Public business pages may also be accessed, copied, linked to or shared by other internet users.

Crab cannot guarantee that information already copied, indexed or shared outside Crab will disappear immediately if a business page is later unpublished or deleted.

12. WhatsApp and third-party services

Crab may allow visitors to open WhatsApp or other external services to contact a business.

Those services are operated by third parties and are governed by their own terms, policies and practices.

Crab does not control the availability, security or conduct of independent third-party services.

The presence of a link to a third-party service does not by itself mean that Crab controls or endorses that service.

13. Business analytics

Crab may provide business owners with basic information about activity on their business pages, such as page views and WhatsApp-button clicks.

Analytics are intended to provide useful indications of activity and may not represent a complete or perfectly accurate measurement of every visitor or interaction.

We may change or improve analytics as Crab develops.

Information about how Crab handles data associated with analytics is provided in our Privacy Policy.

14. Availability and changes to Crab

We want Crab to remain reliable, but we cannot promise that the platform will always operate without interruption or error.

Crab may occasionally be unavailable because of maintenance, technical problems, security incidents, infrastructure failures or circumstances outside our reasonable control.

We may modify, add, remove or improve features as the platform develops.

Where a change materially affects users' rights or access to the service, we will take reasonable steps to provide appropriate notice where required.

15. Suspension and removal

Crab may restrict, unpublish, suspend or remove a business page or account where we reasonably believe it is necessary because of:

  • Violation of these Terms.
  • Unlawful activity.
  • Fraud or deceptive conduct.
  • Serious security risk.
  • Infringement of another person's rights.
  • Misuse of the platform.
  • A valid legal or regulatory requirement.
  • Conduct that could cause serious harm to Crab, its users or others.

Where appropriate and legally permitted, we may provide notice or an opportunity to address the issue.

Serious abuse, fraud, security threats or legal requirements may require immediate action.

16. Closing your account or business

Crab intends to provide controls that allow business owners to manage whether their business remains publicly available and to remove businesses they no longer want on Crab.

Users may also request deletion of their Crab account and associated personal information, subject to applicable legal, security and legitimate retention requirements.

Deleting or unpublishing information from Crab may not remove copies previously shared, downloaded, cached or indexed independently by third parties.

17. Privacy

Your privacy is important to us.

Our Privacy Policy explains what information Crab processes, how it is used, when business information becomes public, our service providers, analytics, retention and your privacy rights.

By using Crab, you acknowledge that information will be handled as described in the Privacy Policy and applicable law.

18. Reports and complaints

If you believe a Crab business page contains unlawful content, infringes your rights, impersonates you or your business, or otherwise violates these Terms, you may report it to Crab.

We may request information reasonably necessary to investigate a report.

Submitting a report does not guarantee that content will automatically be removed. We will consider reports based on the circumstances, these Terms and applicable law.

We will establish and publish the appropriate support or reporting contact before public launch.

19. Disclaimers

Crab provides infrastructure that allows businesses to publish information about themselves.

Unless expressly stated otherwise, Crab does not independently verify every business, product, service, price, claim or piece of information published by users.

Customers should use reasonable judgment when deciding whether to contact or transact with a business.

To the extent permitted by applicable law, Crab is provided on an “as available” basis. We do not guarantee that every feature will always be uninterrupted, error-free or suitable for every particular business purpose.

Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.

20. Limitation of liability

To the extent permitted by applicable law, Crab will not be responsible for losses arising solely from transactions, promises, products, services or disputes between independent businesses and their customers where Crab is not a party to that transaction.

Crab will also not be responsible for events outside its reasonable control.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.

21. Indemnity

To the extent permitted by applicable law, if your unlawful use of Crab, content you had no right to publish, or material violation of these Terms causes a third-party claim against Crab, you may be responsible for losses or reasonable costs arising directly from that conduct.

This provision does not apply where responsibility properly belongs to Crab under applicable law.

22. Changes to these Terms

We may update these Terms as Crab develops, legal requirements change or new features are introduced.

When we update them, we will change the “Last updated” date.

Where changes materially affect users' rights or obligations, we will provide additional notice where appropriate or required by law.

Continuing to use Crab after updated Terms take effect may constitute acceptance where permitted by applicable law.

23. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, subject to any mandatory rights or protections that apply under applicable law.

We encourage users to contact Crab first where a disagreement can reasonably be resolved directly.

Nothing in these Terms prevents a person from exercising rights or using remedies available to them under applicable Nigerian law.
